TOWN OF ROTTERDAM LEGAL NOTICE PLEASE TAKE NOTICE, that a public hearing will be held by the Rotterdam Zoning Board of Appeals on Wednesday, June 15, 2011 in the V. Dalton Bambury Hearing Room, at the John F. Kirvin Government Center, 1100 Sunrise Boulevard, Rotterdam, New York at 7:30 p.m. to consider the following applications: 1) :Robert Iovinella & Timothy Larned - Lands Accessed by Mercer Avenue - Rotterdam, NY, portion of Tax Map #59.16-1-1 located in the Single Family Residential (R-1) Zoning District. The subject property is located off Mercer Avenue and is proposed to be accessed utilizing the existing Town of Rotterdam waterline right-of-way and is abutting Interstate 890 to the west, the lands of NY Central Railroad to the north, and the lands of Niagara Mohawk to the east. Petitioners respectfully requests that they be granted variances as prescribed in the Town of Rotterdam Zoning Code being Chapter 270-31(A) entitled "Lot Area." Chapter 270- 31(A) states that the required minimum lot area shall be not less than 15,000 square feet, with a lot width of not less than 100 feet. The applicant would like to construct one (1) single-family residence on an existing 56,933 square foot parcel that has a lot width of 0 feet, which would require a 100% variance from the 100 foot requirement. The Rotterdam Town Board authorized right of way access to the property on April 27, 2011. 2) Todd Martinelli - Vacant property between 2623 and 2637 Pauline Avenue, Rotterdam, NY, Tax Map #48.20-5-20 located in the Single Family Residential (R-1) Zoning District. Petitioner respectfully requests that he be granted area variances as prescribed in the Town of Rotterdam Zoning Code being Chapter 270-31 entitled "Lot area." Chapter 270-31 (A) states that the required minimum lot area shall be not less than 15,000 square feet, with a lot width of not less than 100 feet. The applicant is requesting variances to facilitate the construction of a single family residence on a 6,250 square foot lot with a 50 foot lot width. This would require a variance of 8,750 square feet for lot area and a variance of 50 feet for lot width. 3) Andrew Brick - 718 Curry Road, Rotterdam, NY, Tax Map #58.7-1-14 located in the Single Family Residential (R-1) Zoning District. Petitioner respectfully requests that he be granted a modification to a previously approved use variance as prescribed in the Town of Rotterdam Zoning Code being Chapter 270-177(c)(2) and Town Law Section 267. The applicant is seeking to modify the existing use variance granted on June 15, 2005 that allowed for the location of a professional office with two (2) office areas on the first floor and the location of a one (1) bedroom apartment on the second floor. He is seeking permission to convert the first floor approved for two (2) offices into a dwelling unit and allow for the location of the one (1) bedroom apartment to remain on the second floor. Wayne Calder won't even go look because he was already told by his "engineers" that it is a good project and will vote the way he is told to vote.  Then he will sit there making a funny face looking confused.
