It doesn't look to me that any of those tracks are on land where the owner knows it's going on, It sure looks like at least one of those tracks is on power line land. And if you use Dahlia to get it to, you're trespassing at the very least. I know that way well, I used it snowmobiling in the 70's/

OMG! You were trespassing!

BTW, trespassing only applies to posted properties detailing the restrictions.

The track on Westside is more than 500 ft from the nearest homes on Dodge Ave. They could hunt there. There is no possible way at 500 ft for a motorcycle to exceed the allowable decible levels.

Bullshit..You can be charged with trespass very easily. How many residential homes do you see with posted signs?

We are not talking about noise levels, but if they were running with OEM pipes, this wouldn't have bubbled up like it did. We are talking about the TOWNS definition of a race track, NOT what you or I define it as, it is what is in the STATUTE.

Tresspassing

Quoted Text
Trespassing is a legal term that can refer to a wide variety of offenses against a person or against property. Trespassing as it relates to real estate law means entering onto land without consent of the landowner. There are both criminal and civil TRESPASS laws. Criminal trespass law is enforced by police, sheriffs, or park rangers. Civil trespass requires that the landowner initiate a private enforcement action in court to collect any damages for which the trespasser may be responsible, regardless of whether a crime has been committed. Traditionally, for either type of trespass, some level of intent is required. Thus, the trespasser must not simply unwittingly traverse another's land but must knowingly go onto the property without permission. Knowledge may be inferred when the owner tells the trespasser not to go on the land, when the land is fenced, or when a "no trespassing" sign in posted. A trespasser would probably not be prosecuted if the land was open, the trespasser's conduct did not substantially interfere with the owner's use of the property, and the trespasser left immediately on request.
Landowner Consent
Express Consent

The landowner may indicate, verbally or in writing, permission to enter onto the land.
Implied Consent

The existence of consent may be implied from the landowner's conduct, from custom, or from the circumstances. Consent may be implied if these factors exist: the landowner was unavailable to give consent and immediate action is necessary to save a life or prevent a serious injury. Additionally, some states may extend this protection to animals.

You know what???/ I know more than what you think I know.....and that's it...

first of aill .....race bikes are louder when they are in races....Harleys  annoy even one bike......but how about the neighbors who have to run and tune their
Harleys even before they run them on the street.....that's even more annoying....all hours of the day and night..

racing bikes are tuned and ready to go.....and most racing families are fully respectful of their neighbors.......

second.....burning continues at the West end of Town nightly...even in winter....and you can tell whether it's fireplaces or garbage.....

third...west end has illegal garages for repair, etc.,

fourth....neighbors intentionally putting leaves in the road ...snow in the road......from their property....

and on and on it goes.....when you report it....police don't respond in the right way....either they know the people or were told not to ticket

This Town does not obey rules ...because they have their own rules....nothing is enforced..niot just Westside Ave..

Who are we paying to enforce the code of the Town.....must be a waste of money so far as I am concerned.

With that said......we have a problem with a lot of issues that are not ever addressed....not j

And yes, west end has many bike tracks that are not legal nor do they have permission to use the property...

Almost forgot.....how about the guys who hunt on posted land and when hunting is not in season.....no tag.....no permission.....Cimino Lane one example...

The Dahlia st area is customarily used by off roaders and hunters.

If you have ever been hunting you know where you can hunt and where you can't.(where it's posted)

Oh more to the point where you won't get caught.
Common courtesy gets thrown out the window when it comes to a gun or a ATV

Where do I start?
Garages aren't illegal on Hungry hill. What could you possibly mean by that?
Leaves in the road? Come on! Get a leaf blower.
If someone hunts on posted land, that is between them, the landowner and the game warden.
There are no illegal bike tracks.

he isn't talking about Hungry Hill...There was one in particular that ran for over 20 years at a residential location.
it was run by a highway dept employee and town vehicles and police vehicles were on the premises at one time or another. the only reason he left is his back couldn't take lying on the ground any longer so he had to rent a stall with a lift.

No illegal bike tracks? i assume the landowner knows of and has given approval of the tracks?

Wake up and get your head out of the sand.

Correction: Dirt bikes are louder than legal street bikes.

I agree, open pipe Harleys are above the legal exhaust decibel limit. Someone keeps issuing them NYS inspection stickers though.

Aside from that, Harleys don't run at the Westside ave location.

I happen to know of more MX style tracks in Rotterdam. Go to google maps and click on satellite view. Head over to Cimino lane, just past Stewarts on Princetown rd. Zoom in to the end of Cimino and just above it are 2 very large off-road dirt tracks. I have been to both of them.

Paste this in to google maps using satellite view and you will see both of these tracks:

42.800006,-74.010163

2 more tracks are located just below the giant Golub warehouse off Duanesburg rd. If you follow Evans rd off of Dunnsville you will see these 2 large dirt tracks located  in the area to the right of Evans rd, below Golub, and to the left of Dahlia st. I always got there from Dahlia st. It gets very swampy during the rainy season in this area.

Just paste this into google maps and zoom in a bit to see both tracks. Make sure that you are in satellite view.

42.779271,-73.993779

Why not take the gripes to the town and ask them to start to enforce them?  Maybe the situation will be taken care of, or maybe fines are in order until they are under compliance.  And do you know these are used as Motocross tracks or is it possible they're used solely as bicycle tracks, which would be legal, as per the statute.  "or other vehicles propelled by a force other than human energy."

Where is Daddy Bloomberg to fix all this....pretty soon I wont be able to have a cigar on my porch because I would be labeled as a terrorist because my neighbor was
offended.....

LOL!  That's ridiculous.

You would be arrested as a terrorist only if it was a Cuban cigar.
