Patches, you know what they say about ASSuming?

I do ride motorcycles and have been to plenty of races. I don't have open or illegal pipes on my Harley because I respect the law and other people...its not just about me. Maybe open pipe Harleys running past midnight on city streets are part of the reason people don't like motorcycles.
Since I can hear them from over three blocks away, I feel sorry for the people on Dodge St and Westside Ave.

It's arguable if the statute is too broad or not, its never been tested.
At the very least, the town should insure that the vehicles that ride have exhaust that are noise legal.

I beg to differ with you.....zoning there is industrial....racing is not that......there is no prizes.....there  are no contestants...  

there is no start/finish line.....no referees.....no flaggers.....no ambulance that is a given at any racetrack..even an outlaw track...

there is no paid admission.....there is no hot dog stand....there are no announcers.....there are no spotters.....there is no pit or crews..

there are no judges or timers.....there are no positings of results.....there are no heat races....no final races..posting of specific class of races...no programs of

events....and racing events...the riders have to pay  entry fees.

Now DVOR has investigated......what were his results....what are your results if you did.....

NOISE NOISE AND MORE NOISE....

222-2. Definitions.
RACETRACK
Any ground, area or track upon which races, contests or demonstrations of skill or stunts are conducted for the enjoyment or entertainment of the public or for the gratification of the contestants which employ go-carts, stock cars, motor scooters, midget autos, motorcycles, motor vehicles or other vehicles propelled by a force other than human energy.

Most of what you say above is irrelevant because it is not in the statute. It doesn't matter if it was zoned industrial or not. It also doesn't matter what your definition of racing is, its the statute's definition. If they are violating the statute, then it should be enforced..period.

well then...

that statue has to be rewritten.....contestants is the word that is =killing my take on this statute...it it too general...too broad..

any good lawyer could punch holes in it.......

that's what I should have said.....

it's all about the noise.....and there is dicipline and rules as I understand it......someone take a video.....let's make judgement...

and I agree with you......exhaust/mufflers may be the answer....silencers...

The statute has to be enforced, then challenged first, then it can be re-written if shot down.
If silencers are used, that eliminates 95% of the issue. The dust is not something they can do anything about.
I'm betting the bikes/atv's I am hearing from over 3 blocks away are modified and/or illegal.
It's even different than a loud street bike, which is an annoyance for mere seconds. They are an annoyance for as long as they are running since they are essentially stationary.

Then ask the town to change it (good luck).  Until then, it is the town law, and it should be enforced, unlike how it has been.

What I get a kick out of is how this outrages some.....yet...what's going on at Town Hall doesn't get as much dialogue.....

and the fact that the way the environment and quality of living is being affected...manipulating the budget.....and residents

bet this will get a heck of a turnout at the next meeting....everything else goes by the wayside...

anyone heard about Town Dump permits yet????.....needs to be addressed too....

The town has been there and determined it isn't racing. You need to film what you call an actual race and present your evidence. In 3 years no person has ever witnessed an actual race. No proof of a race has ever been presented. Making noise about it just adds to the noise pollution that you wish to reduce.

Wrong, enforcement requires evidence. Dirt bikes are louder than street bikes. They are only being operated within the guidelines of the noise ordinance. You can't argue that noise is the issue by producing evidence that racing is the issue. If noise is the issue, get a meter and check it and compare it to the noise ordinance. If there is a violation, call the police.

I highly doubt that anyone is making any noise at all during restricted noise hours.

The town has already determined that it is not racing on Westside Ave..

Thanks....needed clarification......but I was right......it is not racing...

suggest silencers.....but then the rider thinks he's riding a tricycle....LOL

It's obvious you don't know a thing about bikes... An open pipe Harley is so loud that you would need to look at a tach (if there was one)on a dirt bike to know it was running....and it's not even close.
The town looks the other way on a lot of things. Like a town highway employee running a non registered repair garage at his mothers house (r-1 zoning) for 20 years...Just because it isn't enforced doesn't mean it shouldn't be.

I agree, open pipe Harleys are above the legal exhaust decibel limit. Someone keeps issuing them NYS inspection stickers though.

Aside from that, Harleys don't run at the Westside ave location.

I happen to know of more MX style tracks in Rotterdam. Go to google maps and click on satellite view. Head over to Cimino lane, just past Stewarts on Princetown rd. Zoom in to the end of Cimino and just above it are 2 very large off-road dirt tracks. I have been to both of them.

Paste this in to google maps using satellite view and you will see both of these tracks:

42.800006,-74.010163

2 more tracks are located just below the giant Golub warehouse off Duanesburg rd. If you follow Evans rd off of Dunnsville you will see these 2 large dirt tracks located  in the area to the right of Evans rd, below Golub, and to the left of Dahlia st. I always got there from Dahlia st. It gets very swampy during the rainy season in this area.

Just paste this into google maps and zoom in a bit to see both tracks. Make sure that you are in satellite view.

Let's not forget the town ignoring the illegal brush burning that was done in Masullo Estates a few years back.      ยง215.2 Prohibitions. Except as permitted by section 215.3 of this Part, no person shall burn, cause, suffer, allow or permit the burning in an open fire:    (a) of garbage;

    (d) for onsite disposal, of rubbish generated by residential activities in any city or village; or in any town with a total town population, including incorporated or unincorporated areas, of greater than 20,000;
        The town allowed the burning of large brush piles every weekend and holiday until all the brush was burned even though the residents complained on numerous occasions. It's good to have friends on the town board when you live in Rotterdam.

It doesn't look to me that any of those tracks are on land where the owner knows it's going on, It sure looks like at least one of those tracks is on power line land. And if you use Dahlia to get it to, you're trespassing at the very least. I know that way well, I used it snowmobiling in the 70's/
