We have confirmed the authenticity of the document below that is being circulated to police officers in the South Carolina area.  The Department of Homeland Security has released this advisory to officers.  Interrogations of the suspects indicate that the attempted murder of South Carolina deputy was a gang initiation.  Lexington County Sheriff Deputy Deputy Ted Xanthakis and his K-9 police dog partner were attacked by three illegal aliens with a shotgun but survived on Feb. 8, 2009.

The DHS memorandum we have obtained indicates these illegal aliens were part of SUR-13, which is a known illegal alien membership as well as illegal alien and drug importing paramilitary gang.

BACKGROUND

On February 8, 2009, three undocumented Mexican nationals attempted to
kill a Lexington County Sheriff's Deputy as he was responding to a call
about a suspicious vehicle. The three opened fire on the Deputy's
marked patrol car as he was approaching. The three shooters, ages 15,
18, and 20, are members of the Surenos (SUR-13) street gang. The adults
have been charged with assault and battery with intent to kill. The
15-year-old is being prosecuted in family court for assault and battery
with intent to kill. ICE detainers have been lodged on the adults.

UPDATED INFORMATION

Interviews have determined that the 15-year-old was the shooter and this
was a "gang initiation." The juvenile was suppose to "Kill a Cop" in
order to get into the gang. Gangs have long posed a threat to public
safety and law enforcement but the threat is now increasing in scope.
Never before have the street gangs in South Carolina actively targeted
law enforcement officers for gang initiation.

Lexington County Sheriff’s Department deputies and members of a U.S. Marshals Service fugitive task force on Sunday, February 8 arrested two men and one 15-year-old boy on charges that they tried to fatally shoot a sheriff’s deputy who was responding to a call from a citizen concerning a suspicious vehicle on Oakwood Drive near West Columbia.

Lexington County Sheriff James R. Metts said the two men and 15-year-old boy opened fire with a 12-gauge shotgun while Deputy Ted Xanthakis and his K-9 police dog partner, Arcos, were in Xanthakis’ marked patrol car. Pellets from the shotgun damaged the door frame and windows on the passenger’s side of the patrol car. Xanthakis and Arcos were not injured.

Deputies arrested Carlos Alfredo Diaz De Leon, 17, of 600 Ermine Road, Lot 697, West Columbia, and Lucino Guzman Guttierrez, 20, of 600 Ermine Road, Lot 504, West Columbia, on a charge of assault and battery with intent to kill, Metts said. De Leon and Guttierrez were being held on Sunday at the Lexington County Detention Center while awaiting bond hearings. In addition to being charged with assault and battery with intent kill, De Leon was charged with unlawfully possessing a handgun and driving without a valid driver’s license.

Deputies also took custody of a 15-year-old boy, who was being housed on Sunday at a pre-trial detention facility on Broad River Road in Columbia that is operated by the South Carolina Department of Juvenile Justice, Metts said. The boy will be housed at the facility until he appears for a hearing in family court in Lexington County. Detectives will recommend that the boy be prosecuted in family court on a charge of assault and battery with intent to kill. Under South Carolina law, Metts cannot identify the 15-year-old boy because the boy is a child.

De Leon, Guttierrez and the 15-year-old boy illegally entered the United States from Mexico, Metts said. The Sheriff’s Department will work with U.S. Immigration and Customs Enforcement concerning the immigration status of De Leon, Guttierrez and the 15-year-old boy.

Guttierrez is a member of a criminal gang, Metts said. Detectives are investigating whether De Leon and the 15-year-old boy also are members of the criminal gang. The motive for the shooting incident remains under investigation.

At 3:08 a.m. on Sunday, Xanthakis drove up to 2724 Oakwood Drive to help fellow deputies investigate a call about a suspicious vehicle, Metts said. Deputies suspected that the person or persons who occupied the vehicle might be involved in vehicle break-ins.

Xanthakis saw three males running towards him as he drove his marked patrol car on Oakwood Drive, Metts said. After seeing Xanthakis’ marked patrol car, the three males began running towards a perimeter fence at a mobile home park.

One male ran around a shed in order to hide from Xanthakis, Metts said. Xanthakis stopped his patrol car by a clothes line and saw the male point a shotgun towards him.

Xanthakis put his patrol car in reverse gear and backed up, Metts said. The male who had pointed the shotgun at Xanthakis turned and ran. As Xanthakis prepared to get out of his patrol car, he heard a gunshot and saw that a shotgun blast damaged the front passenger’s window of his car. A piece of glass from the window hit Xanthakis in his face.

Deputies later identified De Leon, Guttierrez and the 15-year-old boy as the three males whom Xanthakis encountered on Oakwood Drive, Metts said. Deputies and members of the U.S. Marshals Service fugitive task force took custody of De Leon, Guttierrez and the 15-year-old boy at De Leon’s home at about 10:15 a.m. De Leon possessed a handgun when he was arrested.

After executing search warrants at the homes of De Leon and Guttierrez, deputies recovered items that might have been stolen during vehicle break-ins in Lexington County, Metts said. The items included Global Positioning System devices and car stereo systems. Deputies also recovered the shotgun that was used to shoot at Xanthakis. Officers found the shotgun under a barn on Continental Drive near the intersection with Methodist Park Road near West Columbia.

Metts said the case remains under investigation. The sheriff said detectives might file additional charges against De Leon, Guttierrez and the 15-year-old boy.

  HANNIBAL, Mo. (AP) - A Hannibal police officer was finishing up mundane paperwork on a quiet Saturday morning when Manuel Cazares walked into the station, blood splattered on his hands and shoes.
Cazares put his hands out, crossed them, and told the officer to arrest him.

"I killed two people," he allegedly said.

Details surrounding the allegations are far too common: an abusive relationship, a jilted lover, a sudden attack.


But some in this Mississippi River community of 17,000 best known as Mark Twain's hometown aren't just outraged by the violence. They also question why Cazares was in Hannibal at all.

Cazares admitted after his arrest that he is an illegal immigrant from Mexico. The 32-year-old had several run-ins with law enforcement before the homicides, but officials had never questioned his legal status.

Now he is charged with two counts of second-degree murder and armed criminal action in the Feb. 28 deaths of his ex-girlfriend, 27-year-old Amanda Thomas, and 25-year-old Carl Patrick Epley.

"I don't know how this happens," said Tina White-Masengill, Thomas' sister. "My stepdad told police many times, 'I don't even think the guy's a legal citizen.'"

During his three years in Hannibal, Cazares managed to avoid detection, despite a few traffic violations and a property damage conviction after an arrest for allegedly beating up Thomas and tearing up her home. Thomas had a restraining order against Cazares, who got probation in the property-damage case.

Police say his name wasn't in a database maintained by Immigration and Customs Enforcement. Police and Cazares' boss also say he had authentic-looking identification, including a Social Security card. And police noted that Cazares speaks fluent English.

Cazares' attorney did not return phone messages seeking comment. Cazares is being held in lieu of $1 million bond.

Hannibal police declined several interview requests from The Associated Press, but said soon after the killing that they had received several angry calls, some with racial overtones.

Days after the killings, rocks were thrown through plate-glass windows at the Mexican restaurant where Cazares worked. The FBI decided against opening a hate-crime investigation after concluding that it was vandalism, not retaliation.

Hundreds of messages related to the case were posted on the Hannibal Courier-Post Web site, with several questioning why authorities hadn't been able to determine Cazares' legal status before. One suggested police should conduct raids to seek out other illegal immigrants.

"Of course we have folks who say that's unconstitutional and racial profiling so we have to ignore the problem until this sort of terrible tragedy takes place," the posting read. The newspaper eventually took down the postings.

At a news conference, police Capt. James Hark told reporters that tracking illegal immigrants is a federal responsibility. He said the department is sympathetic to the victims' families, "but, in retrospect, there's nothing in the system that would have prevented this from happening."

ICE spokesman Carl Rusnok said the agency seeks to work closely with local police to uncover illegal immigrants.

"When local law enforcement suspect that they have arrested an illegal alien on criminal charges, we encourage them to forward those suspicions to ICE, where we will make the appropriate determination whether that person is in the country legally or illegally, and whether he is deportable," Rusnok said.

The relationship between Cazares and Thomas had long been rocky, with Thomas seeking restraining orders in 2007 and again early last year. Marion County prosecutor Tom Redington said the first order was dismissed when Thomas failed to appear at a court hearing; the second was dismissed at her request.

Thomas made a third attempt around Thanksgiving and obtained a restraining order that was supposed to keep Cazares away from the small brick duplex where she lived with their 20-month-old son and a 7-year-old daughter from a previous relationship.

Yet neighbors said they often saw Cazares in the area.

"We pulled up one night and he drives up the street with his car lights off and just sits there watching her house," said neighbor Charles Thomas, who is not related to the victim.

In early February, Thomas told police she thought Cazares was stalking her. White-Masengill said her sister played cell phone messages for police, including one in which he said, "No one can love you like I do."

Redington said he didn't have Cazares arrested immediately because of the "on-again, off-again nature of their relationship." He asked Thomas to obtain records that would show that Cazares had been calling her, but she never got the records.

According to court records, Cazares offered the following account of the killings in his confession:

Despite the restraining order, he and Thomas had spent the night of Feb. 26 together after she called him. He thought they would be together again the next night.

Instead, Thomas went out. At some point she met up with Epley, a friend from her nearby hometown of Monroe City.

Cazares fumed when a friend told him he saw Thomas outside a bar. He stayed up late drinking beer, then went to Thomas' home the next morning and found her with Epley.

Cazares said he went to the kitchen, found a knife and stabbed Epley before turning the knife on Thomas.

He then drove around in Thomas' car before using her cell phone to call his mother. He told her "that I loved her and that I did something that was not right and for her to take care of herself."

He said he considered suicide, but instead quietly turned himself in.

DHS Chief Napolitano: Illegal Immigration Is Not a Crime

Homeland Security Secretary Janet Napolitano stunned many listeners during an appearance on CNN when she asserted that illegal immigration is really not a crime.


In an interview with CNN’s John King last week, Napolitano discussed Sheriff Joe Arpaio of Maricopa County, Ariz., a strict enforcer of immigration laws who says he wants illegal aliens to be prosecuted and jailed.


King said: “A lot of Democrats in Congress want you to investigate him. They think he is over the line. He says he is just enforcing the law and the problem is the federal government.”


Napolitano responded: “Sheriff Joe … knows that there aren’t enough law enforcement officers, courtrooms or jail cells in the world to do what he is saying.


“What we have to do is target the real evil-doers in this business, the employers who consistently hire illegal labor, the human traffickers who are exploiting human misery.


“And yes, when we find illegal workers, yes, appropriate action, some of which is criminal, most of that is civil, because crossing the border is not a crime per se. It is civil. But anyway, going after those as well.”


The fact is, crossing the border without authorization is a crime. The statute reads: “Any alien who enters or attempts to enter the United States at any time or place other than as designated by immigration officers . . . shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both.”


Our new homeland security cheif doesn't know the law.

Border Patrol agent killed in San Diego County  
  
  CAMPO, Calif. (AP) - A U.S. Border Patrol agent was shot to death in a remote area of San Diego County as he tracked suspected illegal immigrants or drug smugglers, authorities said Friday.
The agent was identified as Robert Wimer Rosas in a statement from Department of Homeland Security Secretary Janet Napolitano. The Border Patrol declined to release further details until a news conference scheduled for Friday afternoon.


"I am deeply saddened by the tragic death of one of our own," Napolitano said.

Napolitano said she had directed the department to use its full resources to aid in the murder investigation.

The FBI also is investigating, spokesman Darrell Foxworth said.

The agent spotted a suspicious group of people Thursday night in the Campo area near the Mexican border and called for additional agents to help track them, U.S. Border Patrol spokesman Daryl Reed said.

When the suspicious group split up, the agent followed some of the suspects on his own, Reed said.

Other agents lost radio contact with him shortly after 9 p.m. then heard gunshots. They found the agent, who was pronounced dead at the scene.

The San Diego County Sheriff's Department said he was shot in the head.

Law enforcement agencies in the U.S. and Mexico searched both sides of the border but failed to find any suspects.

Since 1919, 108 Border Patrol agents have died on duty, according to The Officer Down Memorial Page Inc., which tracks law-enforcement deaths. Gunfire was the leading cause with 30 deaths, followed by automobile accidents and aircraft accidents.

The Web site, which had already posted Rosas' death, said the agent was 30 and was a three-year veteran who is survived by his wife, a 2-year-old son and an 11-month-old daughter.
