Review reveals U.S. banks sought foreign workers
BY FRANK BASS AND RITA BEAMISH
The Associated Press

SANTA CLARA, Calif. — Major U.S. banks sought government permission to bring thousands of foreign workers into the country for high-paying jobs even as the system was melting down last year and Americans were getting laid off, according to an Associated Press review of visa applications.
The dozen banks now receiving the biggest rescue packages, totaling more than $150 billion, requested visas for more than 21,800 foreign workers over the past six years for positions that included senior vice presidents, corporate lawyers, junior investment analysts and human resources specialists. The average annual salary for those jobs was $90,721, nearly twice the median income for all American households.
As the economic collapse worsened last year — with huge numbers of bank employees laid off — the numbers of visas sought by the dozen banks in AP’s analysis increased by nearly one-third, from 3,258 in the 2007 budget year to 4,163 in fiscal 2008.
The AP reviewed visa applications the banks filed with the Labor Department under the H-1B visa program, which allows temporary employment of foreign workers in specialized-skill and advanceddegree positions. Such visas are most often associated with hightech workers.
It is unclear how many foreign workers the banks actually hired; the government does not release those details. The actual number is likely a fraction of the 21,800 foreign workers the banks sought to hire because the government only grants 85,000 such visas each year among all U.S. employers.
During the last three months of 2008, the largest banks that received taxpayer loans announced more than 100,000 layoffs. The number of foreign workers included among those laid off is unknown.
Foreigners are attractive hires because companies have found ways to pay them less than American workers.
Companies are required to pay foreign workers a prevailing wage based on the job’s description. But they can use the lower end of government wage scales even for highly skilled workers; hire younger foreigners with lower salary demands; and hire foreigners with higher levels of education or advanced degrees for jobs for which similarly educated American workers would be considered overqualified.
“The system provides you perfectly legal mechanisms to underpay the workers,” said John Miano of Summit, N.J., a lawyer who has analyzed the wage data and started the Programmers Guild, an advocacy group that opposes the H-1B system.
David Huber of Chicago is a computer networking engineer who has testified to Congress about losing out on a 2002 job with the former Bank One Corp. He learned later the bank applied to hire dozens of foreign visa holders for work he said he was qualified to do.
“American citizenship is being undermined working in our own country,” Huber said in an AP interview.
Beyond seeking approval for visas from the government, banks that accepted federal bailout money also enlisted uncounted foreign workers, often in technology jobs, through intermediary companies known as “body shops.” Such businesses are the top recipients of the H-1B visas.
The use of visa workers by ailing banks angers Sen. Chuck Grassley of Iowa, the senior Republican on the Senate Finance Committee.
“In this time of very, very high unemployment . . . and considering the help these banks are getting from the taxpayers, they’re playing the American taxpayer for a sucker,” Grassley said in a telephone interview with AP.

I called Kirsten Gillibrand's Washington D.C. number today (202-224-4451) and they said she hadn't decided which way to vote on this yet.  She needs people to call and to let her know that we don't want our money spent on this.  She was against the one in September, she doesn't know what she's going to do as far as voting on this one.  I have a feeling that she voted no because she knew how the vote was going to come out in the House in September and she needed the no vote to help her with her re-election bid.

as we are rounded up for this trek into the canyon.....the battle between capitalism and socialism is being fought on our backs....

so we can all sit here jealous and outraged at our fellow capitalists making $$ as CEO's and complaining that the government is getting too involved

yet say: "someone please help us and fix this"

there are systems in place to deal with crap like this....and both sides are unwilling to use the systems when things go wrong, whether
it be the SEC or bankruptcy laws etc.......why?.......because someone who doesn't like the way they dress/color of their skin/family/religious leanings/power
hungry etc will
use it against them.......

just because something is not deemed illegal doesn't make it right......

The ball has been tossed back into the yard of the companies that are drooling for bailout $$$$$$$$$

maybe it doesn't need a transfusion but a blood letting.......

Obama caps executive pay tied to bailout money
By JIM KUHNHENN, Associated Press Writer Jim Kuhnhenn, Associated Press Writer 13 mins ago

WASHINGTON – President Barack Obama on Wednesday imposed $500,000 caps on senior executive pay for the most distressed financial institutions receiving federal bailout money, saying Americans are upset with "executives being rewarded for failure."

Obama announced the dramatic new government intervention into corporate America at the White House, with Treasury Secretary Timothy Geithner at his side. The president said the executive-pay limits are a first step, to be followed by the unveiling next week of a sweeping new framework for spending what remains of the $700 billion financial industry bailout that Congress created last year.

The executive-pay move comes amid a national outcry over huge bonuses to executives heading companies seeking taxpayer dollars to remain afloat. The demand for limits was reinforced by revelations that Wall Street firms paid more than $18 billion in bonuses in 2008 even amid the economic downturn and the massive infusion of taxpayer dollars.

"This is America. We don't disparage wealth. We don't begrudge anybody for achieving success," Obama said. "But what gets people upset — and rightfully so — are executives being rewarded for failure. Especially when those rewards are subsidized by U.S. taxpayers."

The pay cap would apply .........................http://news.yahoo.com/s/ap/20090204/ap_on_go_pr_wh/bailout_executive_pay

TARP recipients paid $114M to lobbyists
The Business Review (Albany) - by Tierney Plumb For The Business Review

Recipients of the $700 billion federal bailout package in the finance and auto sectors may view their contributions and lobbying as the smartest investments made in years, according to the Center for Responsive Politics.

More than half of the 300 companies helped by the federal government’s Troubled Asset Relief Program (TARP) have dished out $114.2 million for politicking, with $77 million spent on lobbying last year and $37 million spent on federal campaign contributions for the 2008 election.

Those political activities have, in part, yielded the companies $305.2 billion from TARP, or a massive return of 267,208 percent.

“Even in the best economic times, you won’t find an investment with a greater payoff than what these companies have been getting,” said Sheila Krumholz, the center’s executive director, in a statement.

The top three bailout recipients also spent big on campaigns and lobbying, according to the D.C.-based nonprofit.

Bank of America, combined with Merrill Lynch, spent $14.5 million and got $45 billion from the bailout. General Motors spent $15 million and got $10.4 billion, and American International Group spent $10.6 million and was paid out $40 billion.

Of all companies that have been helped by TARP, 25 paid lobbyists $76.7 million to represent them on Capitol Hill last year.

They spent the most during the third quarter of last year, dishing out $20.4 million on lobbying.

“Taxpayers hope their money is being allocated entirely on the merits, but with Congress controlling how much money the Treasury gets to hand out, it will be impossible to completely exclude politics from this process,” said Krumholz, in a statement.

Some of the top recipients of contributions from TARP beneficiaries are members of Congress who chair committees that regulate the financial sector and oversee how well the bailout program works.

In total, members of the Senate Committee on Banking, Housing and Urban Affairs, Senate Finance Committee and ................http://albany.bizjournals.com/albany/stories/2009/02/02/daily35.html?surround=lfn
